MAJ Legal successfully represented its clients before the High Court of Sindh Karachi in Criminal Miscellaneous Application No. 943 of 2025 and secured the setting aside of an order passed by the learned Additional Sessions Judge/Ex-Officio Justice of Peace for registration of an FIR against our clients. The matter arose from allegations concerning ownership and possession of immovable property, where an attempt was made to give criminal colour to a purely civil dispute relating to title and possession.
After detailed hearing and examination of the record, the Hon’ble High Court held that the controversy was essentially civil in nature and observed that the impugned order had been passed without proper application of judicial mind and beyond the lawful scope of jurisdiction under Sections 22-A & 22-B Cr.P.C. The Court further reaffirmed that criminal proceedings cannot be used as a tool to pressure lawful owners in property disputes and restrained the authorities from taking any coercive or adverse action against our clients. Consequently, the impugned order and all proceedings arising therefrom were declared to be of no legal effect.
